Este estudio examina el caso del Proceso Constituyente Abierto a la Ciudadania en Chile (2016), como metodologia para el cambio constitucional. Las investigaciones sobre incidencia de procesos constitucionales en el resultado del texto constitucional senalan que el proceso de cambio constitucional es clave en los resultados esperados, y que las metodologias participativas deben tener ciertas caracteristicas para obtener resultados (Ginsburg,et.al. 2009; Bonar, 2017; Soto & Welp, 2019). Desde la teoria de la democracia deliberativa y de la elaboracion participativa de la Constitucion, el presente trabajo analiza el diseno e implementacion de la etapa participativa para el cambio constitucional realizada en Chile en 2016. Some people have become disenchanted with modern bureaucratic forms and modern governments, and in their attempts to imagine an alternative, have joined the sovereign citizen counterpublic, a right-leaning movement comprised of loosely affiliated groups rejecting the validity of national laws that are present in the United States, Australia, Canada, Germany, the United Kingdom, and other countries. These groups focus their energies on legal systems as they resist modern institutions and have developed a shared semiotic ideology about how legal language works and how legal texts should be interpreted. This semiotic ideology hinges upon a particular form of semiotic determinacy; our article unpacks its implications. Sovereign citizens' ideology is antithetical to how institutionally entrenched actors understand the interplay of semiotic determinacy and indeterminacy in legal contexts, which leads their logics and historical narratives to resonate with conspiracy theories. We conclude by exploring how this counterpublic re-configures older strands of Enlightenment and Protestant Reformation logics as resistance in this neoliberal moment.

Much contemporary research on prefigurative legality turns to left-leaning activists for ethnographic insights into practices that call forward an alternative legal world. We turn instead to a right-leaning movement commonly known by scholars as the Pseudolaw movement-or self-named (by some involved) as the sovereign citizen movement-filled with loosely affiliated groups that share a common ideological approach to law. We discuss the underlying logics motivating sovereign citizens' practices, discussing how a nostalgically based form of prefiguration shapes sovereign citizens' responses to contemporary neoliberal dilemmas. We then compare this right-leaning movement's approach to prefigurative legality with the approach of left-leaning activists.

Τα ελληνικά δικαστήρια οφείλουν, ελέγχουν αυτεπαγγέλτως τη συνταγματικότητα κάθε διάταξης (ουσιαστικού και τυπικού) νόμου που καλούνται να εφαρμόσουν ασκούντα διάχυτο  δικαστικό έλεγχο.Ο δρόμος αυτός του ελέγχου αντισυνταγματικότητας είναι εξαιρετικά μακρύς και για τους διαδίκους επώδυνος.Προτείνεται η άμεση βελτίωση για τις  νέες νομοθετικές ρυθμίσεις, μέχρι να λυθεί το πρόβλημα του προληπτικού ελέγχου της νομοθετικής παραγωγής  από το ΣτΕ  ώστε να είναι κατά το δυνατόν πλήρεις οι ρυθμίσεις, θα ήταν ευκταίο να προβλεφθεί στην διάταξη του άρθρου 58 του ν 4622/2019  και να προστεθεί νέα  διάταξη για  την υποχρέωση για το υπό  νομοθέτηση ζήτημα, της ειδικής αναφοράς στην ισχύουσα σχετική νομολογίας των Ανωτάτων δικαστηρίων και των ΕΔΔΑ, ΔΕΚ, περίληψη των οποίων παρατίθεται ειδικά σε κάθε νέα προτεινομένη  ρύθμιση.

was given formal constitutional recognition. 4 The constitutional entrenchment of minority and group-based entitlements was premised on an understanding of pluralistic democracy that contemplated and required legal recognition of distinctive group-based identities and rights. Such constitutional recognition in the texts of the law, however, does not ensure the effective enjoyment or protection of pluralistic identities in Canadian society. The interaction between constitutional rights and social reality tells a much more complex and less linear story and raises a number of theoretical challenges to protecting group-based rights in constitutional law. These include conceptual problems associated with defining the boundaries of group membership, the risks of congealing essentialist conceptions of group-based identity or overlooking intersectional and multiple identities in legal categories and definitions, legal resistance to abandoning legal formalism and classical legalism, and the problem of mediating conflict within and between social groups. In the face of these social, political, economic, and theoretical challenges, one response is to reject group-based constitutional rights and entitlements and advocate a return to the individual-rights approach of classical liberal constitutional theory. Such a return resonates with neoliberal and neoconservative political agendas and reflects a backlash against what are perceived as special, group-based rights. Another possibility is to imagine alternatives to identity-based rights claims. 5 A third option is to theorize and address the conceptual complexities of groupbased rights without abandoning their importance. 6 Innovative strategies for overcoming some of the challenges of group-based constitutional rights include challenging and revising dominant norms and enhancing participatory, democratic processes to facilitate constitutional dialogue across group differences. At this historical juncture, the creation of a constitutional law that recognizes an inclusive, pluralistic, and diverse conception of citizenship within nation-states is essential not only in Canada but also in countries around the world. 4. Socioeconomic inequality and poverty constitute critical human rights challenges in an increasingly globalized world. Not only do they result in material inequities that affect everyday life; they also undermine psychological and social wellbeing. In this article, issues of economic injustice and social exclusion are examined through the lens of constitutional rights. Three different dimensions of the nexus between economic justice and constitutionalism are explored, including: (i) the role of law in creating socioeconomic inequality and poverty; (ii) the extent to which economic justice is addressed at the interstices of civil and political rights and freedoms; and (iii) the potential for the concept of social inclusion to assist in the reimagining of constitutional law and economic justice.

This article explores a growing emphasis on process issues in the elaboration of constitutional rights and freedoms, focusing on the Canadian Charter of Rights and Freedoms. In a diverse range of contexts, judges are framing constitutional rights and freedoms in terms of the processes and practices they require, rather than in terms of specific constitutionally mandated substantive outcomes. Thus, constitutional rights have been interpreted to require a duty to negotiate, a duty to consult, a duty to accommodate, and entitlements to participate in democratic governance. The growing emphasis on processes and practices is positive to the extent that it resonates with new understandings of social regulation in modern society, empowers institutional and social actors as change makers, and reduces reliance on the judiciary as interpreters of the substantive content of rights in diverse social and institutional contexts. Values of democratic participation, institutional and social transformation, empowerment, and self-governance also emerge with the shift towards processes and practices. And yet, it is also important to consider whether and to what extent a focus on processes and practices risks undermining constitutional protections.

Tujuan penelitian ini untuk menganalisis Ibu Kota Negara Baru Dalam Pandangan Hukum Lingkungan Metode yang digunakan adalah metode penelitian kualitatif dengan jenis penelitian studi pustaka. Jenis penelitian studi pustaka digunakan untuk menggali pemahaman yang mendalam tentang suatu topik atau fenomena dengan menganalisis literatur dan sumber-sumber yang relevan yang dimana dalam penelitian ini berkaitan dengan Ibu Kota Negara Baru Dalam Pandangan Hukum Lingkungan. Adapun data, diperoleh melalui kajian dan analisis terhadap berbagai referensi seperti buku, jurnal ilmiah, artikel, dan dokumen-dokumen lainnya yang berkaitan dengan topik yang diteliti dan kemudian peneliti menarik benang merah dan menyimpulkan dari hasil temuan dan kajian penelitian. Hasil penelitian ini mendapatkan kesimpulan pemerintah memiliki tanggung jawab untuk melaksanakan pemantauan dan pengawasan terhadap dampak lingkungan yang ditimbulkan. Hukum lingkungan memperkenalkan konsep tanggung jawab lingkungan, di mana pihak-pihak yang terlibat dalam proyek bertanggung jawab untuk memantau dan mengelola dampak-dampak lingkungan yang dihasilkan. Jika terjadi kerusakan lingkungan, pihak yang bertanggung jawab harus melakukan tindakan pemulihan dan kompensasi yang sesuai. Pengawasan ini dilakukan untuk memastikan bahwa proyek berjalan sesuai dengan peraturan lingkungan yang berlaku dan tidak menimbulkan dampak negatif yang tidak diinginkan.

Constitutional rights are often seen as invitations to engage in all things considered moral reasoning about how public authorities should act. The Impasse of Constitutional Rights challenges this widely accepted view by showing that it generates an irresolvable deadlock between rival theories of constitutional rights that share the same defects. This Element develops the alternative idea that rights-based constitutional order has its own distinctive moral project, which consists in rendering public authority accountable to the inherent rights of each legal subject. Taking this project seriously requires reconceiving the basic building blocks of rights-based constitutional order: justification, purposive interpretation, and proportionality. The resulting account both escapes the impasse to which the leading contemporary theories of constitutional rights succumb and expounds the normative connection between rights-based constitutional order and its most fundamental doctrines.

This constitutes an original account of autocracy, authoritarianism and liberal-democracy. We explore autocratic, authoritarian and liberal-democratic leadership, as phenomena of coercion and legitimacy, analysed along four dimensions of power. Autocratic leadership is theorized as a product of coercion. Following Weber, both authoritarianism and liberal-democracy are based upon a belief in legitimate authority. Legitimacy is both a sociological and a normative phenomenon. Authority and liberal democracy are both sociologically legitimate, while only liberal democracy is normatively legitimate. Authoritarianism involves manipulation of responders along the third and fourth dimensions of power. In contrast, liberaldemocracy entails justification and accountability along those same dimensions.

Področje človekovih pravic in temeljnih svoboščin se je intenzivneje razvijalo od 17. stoletja dalje in se je posebej razmahnilo po drugi svetovni vojni, ko so različne mednarodne organizacije s sprejemom pravnih dokumentov ţelele preprečiti mnoţično poniţevanje ljudi in kršitve njihovih pravic. Drţave so se zavezale, da bodo spoštovale pravice posameznih članov druţbe s tem, da drţavni organi ne bodo neutemeljeno posegali v njihove pravice (do ţivljenja, prostosti, zasebnosti, premoţenja in drugo). Poleg tega pa so morale posameznikove pravice zavarovati tudi pred posegi drugih posameznikov, še posebej pred posegi različnih organiziranih centrov moči (podjetij, različnih zdruţenj, medijev in drugih). Človekove pravice so pravice vseh ljudi. Zapisane so v Deklaraciji o človekovih pravicah, v različnih konvencijah, v Sloveniji v Ustavi, podane pa so tudi v posameznih zakonih. S pravicami imajo ljudje tudi dolţnosti, ki jih morajo izpolnjevati, da bi bili do njih upravičeni. Namen opredelitve človekovih pravic in svoboščin je omogočanje razvijanja in uporabe človeških kvalitet, inteligence, talentov in vesti ter zadovoljevanja duhovnih in drugih potreb. Varstvo človekovih pravic in temeljnih svoboščin je zagotovljeno predvsem s sprejemom in spoštovanjem Ustave Republike Slovenije in mednarodnih pravnih aktov na svetovni ravni. Civilnopravno varstvo ščiti interese posameznika in išče ravnoteţje z interesi drugih. Išče vzrok, ki je privedel do kršitve med dvema osebama in odgovornost prizadetih. Sankcije so predvsem premoţenjske narave in so odvisne od posledic storilčevega ravnanja, torej od škode, ki jo je povzročil ali morebitne koristi, ki jo je pridobil. Individual freedom is one of the fundamental values protected by the European Convention on Human Rights, due to its importance, requiring a rigorous review by the European Court of Human Rights of any measure that could infringe this value. At the same time, this fundamental right is protected by the Constitution of the Republic of Moldova and the Code of Criminal Procedure, due to which individual freedom is inviolable, and its coercion is allowed only in cases and with the procedure strictly regulated by law. The book under review engages with the question of how the Russian nation is defined and built in the twenty-first century, focusing on inclusionary Russian nationalism based on patriotism. It offers a differentiated approach to nation building and develops a theory of legitimating nationalism, based on material from Buryatia, Karelia, and Tatarstan—three ethnically defined republics in the Russian Federation—collected in the 2010s. In particular, she examines how regional elites adapt national narratives to their local contexts, thereby enhancing the regime’s legitimacy.

Amid the political turmoil following the United Kingdom's popular vote on 'Brexit', the United Kingdom Supreme Court has recently handed down its highly-anticipated ruling in Miller. This judgment conveys remarkable insights about the United Kingdom Supreme Court's perception of the relationship between the national and European legal orders. We invited Oliver Garner, a Ph.D. researcher at the Law Department of the European University Institute working on the legal ramifications of 'Brexit' and an editor of our journal, to write an editorial on the implications of this ruling. Oliver puts the ruling in a broader perspective, comparing it to two other recent national court decisions: Dansk Industri from the Danish Supreme Court and Taricco from the Italian Constitutional Court.

Este ensayo comienza con el desafío planteado por los organizadores de este liber  amicorum de vincular la obra del profesor Mitidiero, con la  escuela de La Plata, con el cine argentino, y también con nuestra historia común, esta tarea que parece compleja en un comienzo, a poco de pensarlo van surgiendo múltiples conexiones que me llevan a homenajear a Daniel Mitidiero con este texto que intentará un dialogo con algunas
de sus ideas, y es por ello que propongo el título, parafraseando una de sus obrastraducidas al español, junto a una significativa cita de la película “El Secreto de sus ojos”, conexiones que en este breve texto intentaré explicar.

Andrés Manuel López Obrador, y sus seguidores, al no reconocer los resultados de la elección cuestionaron la legitimidad del orden político vigente y del presidente electo al plantear la acusación de haber convertido a "la voluntad electoral en apariencia" y a las instituciones políticas en "una farsa grotesca" para dar lugar a la continuación de un "régimen de corrupción y privilegios" que favorece a una "minoría de banqueros, hombres de negocios vinculados al poder, especuladores, traficantes de influencias y políticos corruptos" a costa del "destino del país y la suerte de la mayoría de los mexicanos". 5 Pese a todo, la reacción general de la opinión publicada, fue tomar el reclamo López-Obradorista como una expresión del carácter "tropical" y autoritario con el que se le identificó durante la campaña electoral, y, como una respuesta 5 Así, el 16 de septiembre, ante la "Convención Nacional Democrática" (CND), AMLO dirá: Esta Convención Nacional Democrática ha proclamado la abolición del actual régimen de corrupción y privilegios y ha sentado las bases para la construcción y el establecimiento de una nueva República. Nuestra decisión y la de millones de mexicanos aquí representados es la respuesta firme y digna a quienes volvieron la voluntad electoral en apariencia y han convertido a las instituciones políticas en una farsa grotesca. ¿Cómo se originó esta crisis política y quiénes son los verdaderos responsables? Desde nuestro punto de vista, la descomposición del régimen viene de lejos, se acentuó en los últimos tiempos y se precipitó y quedó al descubierto con el fraude electoral. Esta crisis política tiene como antecedente inmediato el proyecto salinista, que convirtió al gobierno en un comité al servicio de una minoría de banqueros, hombres de negocios vinculados al poder, especuladores, traficantes de influencias y políticos corruptos. A partir de la creación de esta red de intereses y complicidades, las políticas nacionales se subordinaron al propósito de mantener y acrecentar los privilegios de unos cuantos, sin importar el destino del país y la suerte de la mayoría de los mexicanos. Desde entonces, el principal lineamiento del régimen ha sido privilegiar los intereses financieros sobre las demandas sociales, y aún, sobre el interés público.

The essay addresses the issue of the precariousness of the law. It is observed as an effect of the crisis of the system of sources; but also as a problem of positive constitutional law in light of the substantial principle of the «full development of the human person».

Gender identity, as an expression of personal identity, constitutes a fundamental right that is presupposed, recognised, and protected under the Constitution. The legal process of gender reassignment amends the identity recorded in the civil status registers, thereby introducing a discontinuity with the natural fact of birth. Within this legal context, the sexualisation process is conceptualised as a juridical fact in the strict sense, independent of the will of the individual, thereby advancing a legal and cultural framework that endorses gender reassignment even in the absence of surgical intervention modifying or extinguishing primary sexual characteristics. Recent jurisprudential developments from the European Court of Human Rights in Strasbourg, coupled with competitive events at the Paris Olympic Games, underscore the necessity to reconcile the competing interests of athletes, ensuring respect for their dignity and fundamental rights while maintaining sector-specific regulatory rationality to safeguard fair competition. This legal balancing act seeks to protect both cisgender athletes and those who are trans or intersex. The International Olympic Committee (IOC), through successive regulatory frameworks, has delineated specific provisions governing the participation of trans and intersex athletes in competitive sports. Initially, the IOC adopted testosterone levels as the determinative criterion for eligibility in competitive events. However, since 2021, the IOC's approach has shifted towards more inclusive regulatory policies, affirming genuine "gender selfdetermination" and opposing the discriminatory effects perpetuated by previous regulatory practices. Notwithstanding this shift, ongoing media discourse continues to question the perceived failure to observe fairness principles, particularly in instances where cisgender athletes compete against transgender or intersex athletes. This entire issue must be viewed in light of recent constitutional amendments recognising sport as a fundamental human right. Accordingly, sport, like other social formations, is entrusted with performing a "socializing", "educational" and "health-promoting" function, irrespective of an individual's physical or mental conditions. In this regard, sport must serve as a vehicle through which individuals may express their personality, personal identity, and, more specifically, their gender identity.

Do thời gian gấp rút, tác giả mới chỉ có cơ hội trao đổi qua email trực tiếp với ông Andy Beattie – Chief Parliamentary Counsel của Scotland và được giới thiệu một số thông tin về mô hình luật sư làm việc cho Chính phủ Scotland cũng như nghiên cứu về mô hình luật sư công của Úc.
Để hoàn thiện dự án, Bộ Tư pháp cần tìm kiếm và nghiên cứu các tài liệu học thuật quan trọng về luật sư công ví dụ như các tài liệu được trích dẫn trong bài viết “The Unique Role of Government Lawyers in Canada”để nắm được những vấn đề chủ chốt cần nghiên cứu về lĩnh vực này.
Ngoài ra, Bộ Tư pháp cần chủ động tiếp cận với các chuyên gia, các luật sư công trực tiếp hành nghề tại các quốc gia để tham khảo mô hình hoạt động của họ như Singapore, Trung Quốc, Úc, Canada, v.v.

Florent Tap Docteur en droit Université Toulouse Capitole Solution. -Saisi d'une contestation dirigée contre une loi du pays polynésienne promulguée prématurément, le Conseil d'Etat admet la possibilité d'exercer un recours par voie d'action à l'encontre de la loi du pays et de son acte de promulgation. La promulgation irrégulière est en l'espèce validée par les « circonstances particulières de l'espèce » et le maintien du droit au recours pour les justiciables. Apport. -Par cette décision, le Conseil d'Etat comble une lacune de la loi organique du 27 février 2004 en admettant pour la première fois la possibilité de former un recours par voie d'action contre une loi du pays promulguée prématurément, et fixe précisément le régime contentieux applicable. Dans la droite ligne de la décision du Conseil constitutionnel du 26 mars 2020, le Conseil d'Etat valide ce manquement procédural au nom des « circonstances particulières de l'espèce ». C'est une « invitation au pragmatisme » que formule dans cette affaire le rapporteur public Alexandre Lallet dans ses conclusions à l'endroit du Conseil d'Etat. Du pragmatisme, il en fallait en effet à la juridiction administrative suprême pour rendre sa solution, au moins à deux égards. D'une part en raison de la situation contentieuse tout à fait spécifique des lois du pays polynésiennes qui paraît échapper à toute entreprise de systématisation et, d'autre part, en raison du contexte exceptionnel d'état d'urgence sanitaire dans lequel la « loi du pays » contestée a été adoptée, contexte qui commande parfois au juge de fermer les yeux sur certaines irrégularités procédurales au nom des désormais célèbres « circonstances particulières de l'espèce ». L'article 74 alinéa 8 de la Constitution habilite le législateur organique à déterminer, s'agissant des collectivités d'outre-mer dotées de l'autonomie, « les conditions dans lesquelles le Conseil d'Etat exerce un contrôle juridictionnel spécifique sur certaines catégories d'actes de l'assemblée délibérante intervenant au titre des compétences qu'elle exerce dans le domaine de la loi ». W innych dziedzinach SK korzysta z pozycji niekontrolowanego dzierżyciela władzy. Dotyczy to nie tylko kierunku jego orzeczeń, lecz także zakresu jego kognicji. Jeśli ma ochotę rozstrzygnąć o jakiejś sprawie, to zawsze znajdzie argumenty uzasadniające, że należy ona do jego właściwości. Niżej rozważam sześć aspektów komentowanej sprawy. W każdym z nich aktywistyczne podejście Sądu Konstytucyjnego budzi zasadnicze zastrzeżenia.

Kniha je určena především jako učební text pro studenty právnických fakult. Kniha má podtitul Základy ústavného práva Českej republiky, Maďarskej republiky a Poľskej republiky a podle jednotlivých zemí je tvořena i třemi relativně samostatnými díly. Ústavní systém České republiky zpracovala Věra Jirásková z Právnické fakulty Univerzity Karlovy, maďarský a polský systém pak Ladislav Orosz z Právnické fakulty Univerzity P. J. Šafárika, který také působí jako soudce Ústavního soudu v Košicích. Všem třem státům je věnována zhruba stejná pozornost, i když při podrobnějším porovnání přece jen vystoupí do popředí rozsah věnovaný ústavnímu systému České republiky. To může čtenáře v Čechách, na Moravě a Slezsku potěšit, ale zřejmě nejvíce ocení díly věnované ústavnímu systému maďarskému a polskému. Zvláště maďarský systém a to i díky jazykové bariéře není u nás dobře znám. Kniha je psána dvojjazyčně podle mateřského jazyka autorů. Část Věry Jiráskové věnovaná České republice je v češtině, zatímco část věnovaná Maďarsku a Polsku, jakož i úvod Ladislava Orosze je ve slovenštině. Každý z dílu věnovaných konkrétnímu státu má část pojednávající o moderním ústavním vývoji od konce první světové války. Stručně jsou načrtnuty charakteristiky jednotlivých ústav anebo velkých ústavních změn, byť formálně šlo jen o novelizace ústav, nikoliv ústavy nové (federalizace Československa, změna maďarské a polské ústavy dle politických změn roku 1989). Dále se věnuje pozornost suverenitě lidu, kde je pojednáno o uplatnění přímé demokracie (referendu), volebním systému a právní úpravě politických stran. Další kapitola je věnována ústavním orgánům a to v pořadí jejich ústavní úpravy (parlament, prezident, vláda, soudní orgány, případně další orgány jako prokuratura, centrální banka, kontrolní úřad, veřejný ochránce práv). Samostatné kapitoly jsou věnovány územní samosprávě a základním právům. Při ústavní komparaci je možné postupovat dvojím způsobem. Buď určit základní strukturu institutů ústavního systému a ty postupně popisovat ve všech srovnávaných zemích bez ohledu na to, zda určitý institut je obsažen v ústavě dané země vyčerpávajícím způsobem, má pouze velmi obecné ústavní zakotvení či je zakotven jen obyčejnými zákony. The drug release behavior of pH-sensitive starch-based hydrogels was systematically studied. Hydrogels were synthesized by copolymerization of acrylic acid (AA) and other acrylate comonomers onto the starch backbone. The hydrophilic agents 2-hydroxy ethyl methacrylate (HEMA), and acrylamide (AAm), as well as the hydrophobic butyl-methacrylate (BMA), were utilized as comonomers. Methylene-bisacrylamide (MBA) was employed as a crosslinking agent. The synthesized hydrogels were loaded with caffeine as a model drug. The effects of the hydrophobic/hydrophilic character of the comonomers and chemical crosslinking on the swelling capacity and the release rate of caffeine were investigated. The use of the crosslinking agent and hydrophobic monomers decreased the swelling capacity of the hydrogels. The release rate of caffeine increased with the presence of a hydrophobic monomer. Problemy dotyczące konstytucyjności poprawek konstytucyjnych (i co za tym idzie -dopuszczalności sądowej kontroli tych poprawek) budziły zainteresowanie doktryny już w okresie międzywojennym (by wspomnieć tylko Carla Schmitta), a ostatnio stały się przedmiotem wielu studiów w różnych systemach prawnych. Praca izraelskiego uczonego Yaniva Roznaia, nawiązująca do doktoratu obronionego w London School of Economics oraz badań prowadzonych w Herclijji i kilku ośrodkach amerykańskich, stanowi interesujące podsumowanie obecnego, bogatego już dorobku światowej doktryny. Zawiera zarazem interesujące propozycje teoretyczne, mogące stanowić punkt wyjścia dla dalszych przemyśleń i dyskusji, także na tle aktualnych zagrożeń dla polskiego konstytucjonalizmu. Już w tym miejscu stwierdzić należy, że jest to praca wartościowa, oparta na szerokiej analizie doktryny i praktyki, a w swych wnioskach -erudycyjna i inspirująca. Bez wątpienia warta jest polecenia polskiemu czytelnikowi. Rozważania o konstytucyjności poprawek konstytucyjnych mają sens oczywiście tylko przy założeniu, że między normami konstytucyjnymi istnieje wewnętrzna hierarchia, a więc poprawki konstytucyjne muszą pozostawać w zgodzie z pewnymi normami, zasadami czy wartościami o nadrzędnej mocy prawnej.
