The two psychiatrists portrayed in the award-winning movie Silence of the Lambs-Dr. Hannibal Lector and his keeper, Dr. Chilton-represent two of the more prevalent caricatures of the profession: the evil wizard and the pretentious buffoon. As commonly as such stereotypes are applied to physicians, they are even more commonly applied to psychiatrists. They are conjured up perhaps most intensely in relation to those psychiatrists who sail the treacherous shoreline where psychiatry and the law meet: forensic psychiatry. This shoreline might be considered an endangered area, having survived repeated tidal waves of public sentiment to have it declared off-limits. The latest such tidal wave arose in the early 1980s, particularly in the aftermath of the verdict of "not guilty by reason of insanity" in the trial of John Hinckley, who nearly succeeded in assassinating President Ronald Reagan. Most politicians are lawyers. It is thus no surprise that lawyer/politicians often find it easier to attack psychiatrists than fellow attorneys, especially those who have become judges. As the distinguished jurist David Bazelon is said to have remarked, "The problem with forensic psychiatry in the courtroom is that the average attorney does not know how to consult the average forensic psychiatrist." Despite such barriers to open-minded consideration of forensic psychiatric testimony, the specialty of forensic psychiatry has continued to grow. Attorneys and judges who practice in the Bazelon tradition find the deep human understanding offered by psychiatrists indispensable to the administration of justice. Child victims of sexual abuse may present with physical findings that can include anogenital problems, enuresis or encopresis. Behavioral changes may involve sexual acting out, aggression, depression, eating disturbances and regression. Because the examination findings of most child victims of sexual abuse are within normal limits or are nonspecific, the child's statements are extremely important. The child's history as obtained by the physician may be admitted as evidence in court trials; therefore, complete documentation of questions and answers is critical. A careful history should be obtained and a thorough physical examination should be performed with documentation of all findings. When examining the child's genitalia, it is important that the physician be familiar with normal variants, non-specific changes and diagnostic signs of sexual abuse. Japanese law is of postmodern essence. Subsequent to the end of the Tokugawa era and as awareness of Japan's legal environment grew, Japanese law began to be described as postmodern. When considered on an international basis, Japan is truly a unique society, engaging in extensive transnational activities while still retaining a distinctly 'Japanese' identity. This article posits that Japan has attained a state of postmodernity in many respects, but particularly in its approach to law and its legal environment. As evidence of this claim, this article will consider the historical and contemporary aspects of Japanese law, including the legal reforms since 1868 and the role of socio-cultural influences, such as the culture of apology and the profound concept of giri.

Background: Self-reported antiretroviral therapy (ART) adherence measures that are associated with plasma viral load (VL) are valuable to clinicians and researchers, but are rarely examined among groups vulnerable to dropping out of care. One-seventh of all those living with HIV pass through incarceration annually and criminal-justice (CJ) involved people living with HIV (PLH) are vulnerable to falling out of care. We examined the association of selfreported ART adherence with VL in a criminal-justice sample compared to a routine-care sample. Methods: Samples: We examined data from a multisite collaboration of studies addressing the continuum of HIV care among CjJ involved persons in the Seek, Test, Treat, and Retain cohort. Data pooled from seven CJ-studies (n = 414) were examined and compared with the routine-care sample from the Centers for AIDS Research Network of Integrated Clinical Systems' seven sites (n = 11,698). Measures: In both samples, data on self-reported percent ART doses taken were collected via the visual analogue scale adherence measure. Viral load data were obtained by blood-draw. Analysis: We examined the associations of adherence with VL in both cohorts using mixed effects linear regression of log-VL, and mixed effects logistic regression of binary VL (≥ 200 copies/mL) outcomes. Interactions by CD4 count and self-reported health status were also tested. Results: Among the CJ sample, the coefficient for log-VL was -0.31 (95% CI = -0.43, -0.18; P < 0.01) and that in the routine-care sample was -0.42 (95% CI = -0.45, -0.38; P < 0.01). For the logistic regression of binary detectable VL on 10% increments of adherence we found the coefficient was -0.26 (95% CI = -0.37, -0.14; P < 0.01) and in the routine-care sample it was -0.38 (95% CI = -0.41, -0.35; P < 0.01). There was no significant interaction by CD4 count level in the CJ sample, but there was in the routine-care sample. Conversely, there was a significant interaction by self-reported health status level in the criminal-justice sample, but not in the routine-care sample. Conclusions: The visual analogue scale is valid and useful to measure ART adherence, supporting treatment for CJinvolved PLH vulnerable to falling out of care. Research should examine adherence and VL in additional populations.

A majority of inmates in the state of Connecticut Department of Corrections use opioids or are opioid dependent before incarceration. None of the state's prisons offer opioid substitution therapy other than for detoxification or maintenance therapy for women during pregnancy. On release to the community, most prisoners relapse to drug use and this has been associated with higher recidivism rates, and less adherence to antiretroviral medications for HIV-infected persons. Nationally and internationally, methadone (METH) and buprenorphine (BUP) have been found to decrease relapse to drug use, decrease recidivism rates, improve adherence to antiretroviral medications, decrease HIV-risk taking behaviors, and improve mortality. However, the general knowledge about opioid substitution therapy among correctional facility staff has been reported as substandard. This pilot study compiled results of answers to anonymous surveys from 27 individuals who work directly with inmates in a patient-care capacity for the Connecticut Department of Corrections (CT DOC) and CT DOC case-management referral program (Project TLC) in the year 2006. The surveys included questions regarding current attitudes and knowledge about opioid substitution therapy for prisoners. A minority of respondents refer released prisoners with a history of opioid dependency to METH or BUP treatment. The majority of correctional workers and case-management referral workers did not have knowledge about BUP or METH's ability to improve health and decrease HIV risk taking behaviors. This study found that more education of individuals treating and caring for HIV-infected opioid dependent prisoners is needed.

The death penalty might be useless in the future when people gain more moral integrity, currently, death penalty still holds more advantage than disadvantage.

The COVID-19 pandemic has raised the difficult question of how to ration scarce intensive care resources when a health system is overwhelmed. Despite substantial ethical scholarship addressing these rationing decisions, little is known about the legal position in Australia. This article considers various legal challenges in response to a clinical scenario denying intensive care admission and a ventilator to a critically ill patient with COVID-19. The article considers key challenges in negligence, criminal law, administrative law, human rights law, and under the parens patriae jurisdiction and guardianship legislation, and how they would apply to this scenario. The article concludes that while there are many obstacles to a successful legal challenge, the law can provide important scrutiny and guidance in the design of decision-making processes and triage policies. An Individual Company is a new legal entity intended for Micro and Small Enterprise (MSE) actors to obtain legal entity status. However, based on the taxation perspective, establishing an Individual Company raises the consequence of tax imposition on one party that is substantially the same entity, namely MSEs as Individuals and Individual Companies as Legal Entities. This study intends to examine the taxation responsibility attached to the Individual Company as a law entity so taxpayers can carry out their tax obligations. The study method used is normative juridical with descriptive-analytical research specifications and qualitative juridical data analysis. Apart from the reduced incidence of urinary tract infections in the first year of life, there are currently no medical arguments firmly in favour of circumcision and against sparing the prepuce --with the sole exception of lichen sclerosus et atrophicans, which is rare in children.Not infrequently, parents and child prefer the phimosis to be corrected without removal of the prepuce, in order to preserve the "natural" appearance of the penis.Various investigations have shown a lesser postoperative requirement for analgesics and a better subjective cosmetic outcome after reconstruction of the prepuce.In mild phimosis, "foreskin training", possibly together with antiphlogistic ointment, may be successful.In the case of persistent phimosis, we recommend giving the family all available information on the potential surgical procedures with and without preservation of the prepuce.In the absence of convincing medical arguments for or against, the decision may be based on individual aesthetic preferences.In our opinion the triple incision technique, a swift, simple and safe operation, represents a good alternative to circumcision.

Three experiments were conducted to test the hypothesis that difference in voluntariness judgment for a custodial confession filmed in different camera focuses (''camera perspective bias'') could occur because a particular camera focus conveys a suggestion of a particular cognitive frame. In Experiment 1, 146 juror eligible adults in Korea showed a camera perspective bias in voluntariness judgment with a simulated confession filmed with two cameras of different focuses, one on the suspect and the other on the detective. In Experiment 2, the same bias in voluntariness judgment emerged without cameras when the participants were cognitively framed, prior to listening to the audio track of the videos used in Experiment 1, by instructions to make either a voluntariness judgment for a confession or a coerciveness judgment for an interrogation. In Experiment 3, the camera perspective bias in voluntariness judgment disappeared when the participants viewing the video focused on the suspect were initially framed to make coerciveness judgment for the interrogation and the participants viewing the video focused on the detective were initially framed to make voluntariness judgment for the confession. The results in combination indicated that a particular camera focus may convey a suggestion of a particular cognitive frame in which a videorecorded confession/interrogation is initially represented. Some forensic and policy implications were discussed.

El capítulo dos asume la memoria perlaborativa y su conexión con el diseño comunitario, desde las perspectivas del diseño social y ontológico de Ezio Manzini y Arturo Escobar. El tercer capítulo permite comprender desde una perspectiva amplia, los procesos de dolor y curación que han sido utilizados por comunidades en Colombia, quienes, al margen de las tecnologías más avanzadas, han desarrollado prácticas de cuidado colectivo, como una forma de resistencia para mediar con el dolor de la guerra. Este texto se caracteriza, además, por la pluralidad en los enfoques. Coincidimos en dos categorías centrales: la democracia y la política, pero las argumentamos desde las experiencias que nuestros trayectos de vida nos han permitido construir, que nos constituye e identifica en cuanto ciudadanas y ciudadanos interesados en la potenciación de tales categorías.

The 5,473 confessions recorded at Toulouse by the inquisitors Bernart de Caux and Johan de Saint-Pierre that have come down to us in Toulouse, BM, MS609 were taken on 231 days between May 1245 and July 1246. This manuscript, the oldest original inquisitorial registry extant, and the range of confessions it contains, has been a resource for historians for over 150 years. Yet the operations of this inquisition itself, a mammoth task of record creation and organization, has never been subjet to rigorous analysis. Drawing from data from the recent digital edition of MS609, this paper investigates how an inquisitorial event of such extraordinary scope could have been executed. In particular, this talk examines the written depositions through a combination of close reading of the content of individual confessions and macroanalysis of features across all confessions to look for indications of organization and execution of this inquisition. These details reveal patterns, unremarked until now, of significant advance coordination between inquisitors and confessants, and between the confessants themselves. These signs of coordination, when put into relation with sources external to the registry, suggest that this inquisition was not a “general search for partisans of heresy” or “a general survey of the state of belief” as has been long argued, but a juridical-political event of a completely different nature whose precise goal was a durable, written record.

Main hakim sendiri (eigenrichting) adalah tindakan untuk menghukum orang lain tanpa melalui proses hukum yang berlaku. Tindakan ini dapat dikategorikan sebagai tindak pidana, karena bertentangan dengan ketentuan Pasal 1 KUHP yang menyatakan bahwa setiap orang dilarang melakukan perbuatan yang dilarang oleh undang-undang. Tujuan penelitian ini untuk mengetahui konsep tindak pidana main hakim sendiri (eigenrichting) menurut hukum pidana positif di Indonesia juga untuk mengetahui dan memahami bentuk pertanggungjawaban pidana terhadap pelaku main hakim sendiri (eigenrichting). Penelitian ini menggunakan metode penelitian hukum normatif-empiris. Hasil penelitian menunjukkan bahwa konsep tindak pidana main hakim sendiri (eigenrichting) menurut hukum pidana positif di Indonesia yang telah diterapkan oleh Jaksa Penuntut Umum di Kejaksaan Negeri Konawe adalah Pasal 170 KUHP Tentang Pengeroyokan, Pasal 338 KUHP Tentang Pembunuhan, dan Pasal 351 KUHP Tentang Penganiayaan. Pertanggungjawaban pidana terhadap pelaku main hakim sendiri (eigenrichting) dalam Putusan Nomor: 194/Pid.B/2022/PN, para pelaku mempertanggungjawabkan perbuatannya berdasarkan kedudukannya dan bentuk perbuatannya. Majelis Hakim menerapkan Pasal 55 Ayat (1) ke-1 KUHP yang mengatur kedudukan pelaku dalam penyertaan tindak pidana yang dinyatakan sebagai pleger (pelaku) oleh Majelis Hakim Pengadilan Negeri Unaha.

Статтю присвячено визначенню й характеризуванню кримінальних процесуальних і криміналістичних засобів виявлення доказів у кримінальному провадженні. Наголошено, що дії уповноважених осіб із цілеспрямованого пошуку джерел (носіїв) доказової інформації є об'єктом криміналістичних рекомендацій. Показано, що на практиці пошук доказів здійснюється шляхом поєднання низки когнітивних (мисленнєвих, логічних) та інструментальних (практичних) операцій. На думку автора, когнітивний складник пошуку спирається на опрацювання уповноваженим суб'єктом наявної доказової й орієнтувальної інформації, а також відомостей про типові характеристики певного виду кримінальних правопорушень. Своєю чергою, інструментальний шлях пошуку доказової інформації включає низку практичних дій уповноваженого суб'єкта, що полягають у використанні сукупності кримінальних процесуальних, оперативно-розшукових, криміналістичних та інших засобів відшукання її джерел (носів). До процесуальних інструментальних засобів пошуку доказів зараховано передбачені КПК України способи збирання доказів, насамперед процесуальні дії пошукового спрямування (огляд місця події, допит, обшук, окремі НС(Р)Д тощо). Криміналістичні засоби пошуку доказової інформації (її джерел, носіїв) включають технічні засоби й техніко-криміналістичні прийоми (як специфічно-пошукового спрямування, так і загального призначення), тактичні прийоми, комбінації та операції пошукового призначення, методико-криміналістичні рекомендації з приводу можливостей пошуку доказових відомостей у провадженнях щодо кримінальних правопорушень певних категорій, а також непроцесуальні інструменти кримінальної (криміналістичної) розвідки: оперативно-розшукова діяльність, кримінальний аналіз, використання даних криміналістичних інформаційних систем (обліків), розвідка з відкритих джерел «OSINT», взаємодія з медіа та громадськістю тощо. Research on mental health courts (MHCs) to date has been disproportionately focused on the study of recidivism and reincarceration over the potential of these problem solving courts to facilitate the recovery process and affect the slope of recovery. This study attempts to shift the focal point of interest from well-established criminal justice outcomes to the experiences and perceptions of MHC participants. The authors hypothesize that the actions of MHC judges that are consistent with procedural justice theory will engender high perceptions of procedural justice among this sample of divertees with SMI. Defendant perceptions of procedural justice in 4 NYCarea MHCs were also compared to those of uninvolved observers. Results suggest that defendant perceptions are distinct from observer perceptions, which tended to be more sensitive to the differences in judges between the four courts. Overall, participants' perceptions of procedural justice were moderate and increased between baseline and 4-month follow-up. Procedural justice was negatively correlated with symptoms at baseline and was positively correlated with participant's attitudes toward their own recovery. Between baseline and 4-month follow-up, participants in our sample tended to increase in perceptions of procedural justice; interestingly, the increase in procedural justice was associated with a decrease in symptoms but not to an increase in attitudes toward the recovery. Implications and future directions are discussed.

U samego początku kształtowania się prawodawstwa dwa fundamentalne zbiory – Dekalog i Lex duodecim tabularum (Ustawa dwunastu tablic) – regulowały zasady życia w społeczeństwie i rodzinie, zakazywały postępowania zagrażającego innym osobom lub naruszającego ich dobra oraz sankcjonowały kult. W ten sposób ukazywano odniesienie prawa do wszystkich dziedzin życia.
Monografia „Państwo i Kościół. Zagadnienia prawne na styku państwa, prawa i religii” stanowi nowy wkład w interdyscyplinarny namysł nad sposobem funkcjonowania Kościoła w odniesieniu do prawodawstwa polskiego i europejskiego. Szerokie ujęcie tematu pozwala zobaczyć, w jak wielu aspektach regulacje prawne mają wpływ na funkcjonowanie Kościoła i jego relacje z instytucjami państwowymi.
Książka składa się z sześciu części. W pierwszej zostały omówione zagadnienia z zakresu prawa międzynarodowego. Ponaddwudziestoletnia obecność Polski w strukturach Unii Europejskiej sprzyja ocenie postrzegania Kościoła katolickiego przez tę wspólnotę państw. Chrześcijaństwo bowiem stanowi korzenie dla europejskich wartości i miało znaczący wpływ na dziedzictwo kultury prawnej i materialnej kontynentu. W miarę kształtowania się kompetencji instytucji unijnych konieczne było również uregulowanie relacji z największą wspólnotą religijną na terenie UE. Drugi podjęty temat prezentuje kształtowanie się relacji państwo–Kościół w Białorusi. Po upadku Związku Radzieckiego konieczne było wypracowanie nowych regulacji prawnych oraz praktyk administracyjnych w tym zakresie. Spowodowało to unikalną konieczność
opracowania kompleksowych rozstrzygnięć i przepisów, które w innych krajach Europy kształtowały się przez stulecia.
Druga część została poświęcona prawu oświatowemu i cywilnemu. Podejmuje temat konstytucyjnej gwarancji pozwalającej rodzicom na wychowanie dziecka zgodnie z własnymi przekonaniami religijnymi. Następnie zostały zaprezentowane cywilnoprawne aspekty dokonywania egzorcyzmów w obrządku rzymskokatolickim. Trzecia część obejmuje zagadnienia dotyczące prawa karnego. Omówiono w niej podobieństwa i różnice w podejściu prawa karnego państwowego i kanonicznym do struktury przestępstwa wykorzystywania seksualnego nieletnich. Zaprezentowano temat odpowiedzialności karnej w przypadku popełnienia przestępstwa wykorzystania seksualnego małoletniego, gdy sprawcą jest członek Kościoła katolickiego.
Komplementarne podejście do zagadnienia pozwoliło na wykazanie podwójnej odpowiedzialności katolików: na mocy prawa państwowego (jako obywatele) i prawa kanonicznego (jako wierny Lud Boży). Podjęcie tematu nowelizacji prawa kanonicznego karnego w zakresie kary latae sententiae miało na celu ukazanie ciągłości w jej rozumieniu.
Czwarta część została poświęcona prawu procesowemu. Rozpoczyna się od analizy zagadnienia współpracy Kościoła ze świeckim wymiarem sprawiedliwości w świetle wskazań Nuncjatury Apostolskiej z 2021 r. Dokument ten doprecyzował oraz ujednolicił w całym kraju zasady przekazywania dokumentacji procesowej wymiarowi sprawiedliwości.
Następnie omówione zostały współczesne wyzwania dla adwokatury kościelnej w Polsce. Artykuł opisuje wymogi formalne pozwalające na zostanie adwokatem kościelnym oraz zawiera wskazania dotyczące etycznego wypełniania tego zawodu. W kontekście prawa procesowego podjęto również refleksję nad skróconym procesem małżeńskim, przed biskupem, w orzecznictwie polskim (2015-2023). Statystyczne ujęcie ukazuje niewielką ilość takich spraw oraz odpowiada na pytanie o przyczyny tego stanu. Piąta część została poświęcona prawu rodzinnemu i sakramentów. Rozpoczyna się omówieniem tematu ochrony małżeństwa w prawie polskim i kanonicznym w kontekście ideologii gender. Rodzina, jako najmniejsza komórka społeczna, jest chroniona przez prawo państwowe – Konstytucję RP, kodeks rodzinny i opiekuńczy oraz prawo cywilne. Interesującym zagadnieniem w kontekście prawa rodzinnego jest również przeszkoda pokrewieństwa duchowego uwzględniona w Kodeksie Justyniana i nomokanonach chrześcijańskiego Wschodu. Artykuł wyjaśnia znaczenie tej przeszkody – nieobecnej w Kodeksie prawa kanonicznego, a wciąż obowiązującej w prawodawstwie katolickich Kościołów wschodnich. Następnie został podjęty temat „Gravis defectus discretionis iudicii (kan. 1095 n. 2 KPK) w orzecznictwie Roty Rzymskiej”. Rozdział poświęcony przygotowaniu do przyjęcia sakramentów omawia również trzy etapy przygotowania do zawarcia małżeństwa w oparciu o przepisy powszechne i właściwe dla archidiecezji warszawskiej. W odniesieniu do chrztu, komunii oraz bierzmowania podjęto również temat potencjalnych oczekiwań wiernych świeckich względem proboszcza w przedmiocie przygotowania i udzielania sakramentów inicjacji chrześcijańskiej. Ukazano między innymi odpowiedzialność duszpasterzy za wielowymiarową formację rodziców, którzy zgodnie z przepisami prawa będą odpowiedzialni za przekazanie wiary potomstwu. W kontekście sakramentu pokuty i pojednania została omówiona ochrona tajemnicy spowiedzi w świetle Kodeksu prawa kanonicznego z 1983 r. Następnie podjęty został temat zmian danych osobowych zawartych w księgach chrztów. Ochrona danych osobowych w tej materii oraz szczegółowe przepisy ją regulujące zostały zaprezentowane na przykładzie parafii personalnych Ordynariatu Polowego w Polsce.
Ostatnia część w największym stopniu odzwierciedla interdyscyplinarny charakter pracy, ponieważ rozpatruje zagadnienia prawne w kontekście historii, filozofii i teologii. Omawia etapy powstania diecezji włocławskiej jako przykład współpracy państwa i Kościoła oraz prezentuje pozycję religii i duchowieństwa na tle zmian polityczno-prawnych w
Rzeczypospolitej w świetle mazowieckich akt sejmikowych 1788-1790. Ukazuje również historyczne aspekty i wpływ prawodawstwa (Edyktu
mediolańskiego, Dekretów Teodozjańskich i Donacji Konstantyna) na proces kształtowania się relacji państwo–Kościół. Przedstawienie teorii prof. Feliksa Konecznego przybliża rolę tej wspólnoty w „politycznym wychowaniu narodów”. Ostatnie zagadnienie podjęte w tej części prezentuje rozumienie prawa przez św. Pawła w Liście do Rzymian. Ukształtowało ono rozumienie tego zagadnienia w całej historii Kościoła.

Introducción El delito de apropiación indebida de tributos está consignado en el art. 4° del Régimen Penal Tributario-cf. ley 27.430-, y castiga penalmente "[a]l agente de retención o de percepción de tributos nacionales, provinciales o de la Ciudad Autónoma de Buenos Aires, que no depositare, total o parcialmente, dentro de los treinta [30] días corridos de vencido el plazo de ingreso, el tributo retenido o percibido, siempre que el monto no ingresado, superare la suma de cien mil pesos ($100.000) por cada mes".

En este trabajo, que escribimos en coautoría con Florencia Rimoldi, proponemos un abordaje epistemológico del contraexamen de testigos tal como —se sostiene— debería ser practicado en el contexto de un sistema adversarial, como el que está en vías de implementación en muchos países de Latinoamérica. Luego de un breve repaso de las particularidades del contraexamen como método de interrogatorio, ofrecemos una presentación de la idea de agencia epistémica, de ciertos conceptos empleados en epistemología del testimonio, del debate entre las aproximaciones evidencialistas e interpersonalistas, de la noción de injusticia epistémica agencial y del concepto de daño epistémico. En particular, examinamos algunas de las técnicas insistentemente recomendadas por los manuales de litigación para la práctica del contraexamen y exponemos ciertas similitudes con mecanismos “extractivos” del testimonio, como la manipulación y la coerción, descriptos por Jennifer Lackey en sus trabajos recientes sobre injusticia epistémica. Sobre estas bases, dejamos a la vista algunas inquietudes que sugieren cautela en la implementación de ciertos aspectos de las prácticas propias del modelo adversarial y, a la vez, abren nuevas posibilidades para pensar modelos virtuosos de intercambios testimoniales en el contexto legal.

Du gouvernement à la « gouvernance » Le souci du dénombrement comme méthode de gouvernement est très ancien. Comme l'a montré Foucault, le gouvernement pastoral des IIIe-IVe sc. procède par dénombrement à des fins de totalisation (omnes et singulatim, littéralement « tous et individuellement »). Cette forme de gouvernement est comme le prélude de l'Etat pastoral moderne : de même que le pasteur ou le berger dénombre matin et soir toutes les brebis de son troupeau, a l'oeil sur toutes et sur chacune, de même l'Etat pastoral moderne opère par dénombrement et par mise en série tout en veillant au sort de chacun pris en particulier. De ce point de vue, la statistique comme « connaissance de l'Etat » acquiert une importance décisive en faisant apparaître une « distribution de cas » à l'échelle des populations (par exemple, pour l'appréciation des risques de mortalité entraînés par telle ou telle maladie 1). Aims: To describe the prevalence of psychiatric morbidity among women inmates in a prison of north India, and possible association of sociodemographic factors with psychiatric morbidity among women inmates. Materials and Methods: Cross-sectional point prevalence study was conducted at a prison in Patiala during August 2007 to July 2008. All 65 women prison inmates were recruited in study. The inmates were interviewed by using a pre-designed pre-tested questionnaire. General Health Questionnaire-12 was used to assess the psychological status of inmates. Chi-square test was used as test of significance. Logistic regression was used to find risk factors of psychiatric morbidity. Results: The prevalence of psychiatric morbidity was found among 40 (61.5%) women inmates. The significance difference was found between psychiatric morbidity and variables i.e. age group (p=0.03) and receiving any visitor (p=0.04). Resumen: El c. 1399 se sitúa en el conjunto del libro VI sobre las sanciones en la Iglesia como una norma general que permite en unas determinadas condiciones imponer una sanción no tipificada. Esta norma, ¿es una excepción o contradicción al principio de legalidad penal?, ¿qué consecuencias comporta mantener esta excepción?, ¿qué consecuencias conlleva la supresión de este canon? La respuesta a estas cuestiones comporta recorrer un itinerario en el que se manifiesta el origen del principio de legalidad en el derecho penal, su presencia en el Codex de 1917 y en el Código vigente para valorarlo en los nuevos horizontes de comprensión y aplicación del derecho penal canónico en el surco de la traditio canonica.

Alibis play a critical role in the criminal justice system. Yet research on the process of alibi generation and evaluation is still nascent. Indeed, similar to other widely investigated psychological phenomena in the legal systemsuch as false confessions, historical claims of abuse, and eyewitness memorythe basic assumptions underlying alibi generation and evaluation require closer empirical scrutiny. To date, the majority of alibi research investigates the social psychological aspects of the process. We argue that applying our understanding of basic human memory is critical to a complete understanding of the alibi process. Specifically, we challenge the use of alibi inconsistency as an indication of guilt by outlining the "cascading effects" that can put innocents at risk for conviction. We discuss how normal encoding and storage processes can pose problems at retrieval, particularly for innocent suspects that can result in alibi inconsistencies over time. Those inconsistencies are typically misunderstood as intentional deception, first by law enforcement, affecting the investigation, then by prosecutors affecting prosecution decisions, and finally by juries, ultimately affecting guilt judgments. Put differently, despite the universal nature of memory inconsistencies, a single error can produce a cascading effect, rendering an innocent individual's alibi, ironically, proof of guilt.
