Ev i dence from the Eu ro pean Union Health BAS KET Pro ject Ab stract This ar ti cle iden ti fies and anal y ses a framework for "health bas kets, " the tax on o my of ben e fit cat a logues for cur a tive ser vices, and the cri te ria for the in-or ex clu sion of bene fits in nine EU mem ber states (Den mark, Eng land, France, Ger many, Hun gary, Italy, The Nether lands, Poland and Spain). Fo cusing on ser vices of cur a tive care, it is found that the ex plic it ness of ben e fit cat a logues varies large ly be tween the coun tries. In the ab sence of ex plic it ly de fined ben e fit cat alogues, in-and out pa tient re mu ner a tion schemes have the char ac ter of ben e fit cata logues. The cri te ria for the in-or ex clu sion into ben e fit cat a logues are of ten not transpar ent and (cost-)ef fec tive ness is ap plied only for cer tain sec tors. An EU-wide har moniza tion of ben e fit bas kets does not seem re al is tic in the short or me di um term as the vari a tion in cri te ria and the tax onomies of ben e fit cat a logues are large but not in surmount able. There may be scope for a Eu ropean core bas ket.

To describe the Danish National Health Service Register in relation to research. The register contains data collected for administrative and scientific purposes from health contractors in primary health care. It includes information about citizens, providers, and health services but minimal clinical information. The register covers everyone living in Denmark and data is available from 1990. No validity studies have been reported. Because the data is connected to reimbursement the coverage is assumed to be good. The strengths of the register include completeness, size, and long follow-up period. It is useful for research purposes but reservations must be made regarding its validity.

Health is a special area of interest of legislation and legal environment, as it has a special meaning for the entire community and includes most of the disciplines of knowledge. Thus, its proper legal regulation is a very difficult and responsible task, as consequences of legal research in a scientific monograph. The “Health law. Selected issues” includes studies presenting the selected aspects of health law. Fourteen lawyers, representatives of science and legal practice, have shared the results of their research. The collective study has been divided into three parts: pharmaceutical law, medical malpractice and varia. All of them are innovative and the aim is to present a broad area of health law interests.

The Committee for the Prevention of Torture and Inhuman Treatment is a body of the Council of Europe that organises visits to places of detention such as social care homes in order to assess how persons deprived of their liberty are treated. This means that in practice people are not free to leave the institution and are therefore de facto deprived of liberty. In such situations, people with disabilities are particularly vulnerable and have limited capacity to make decisions about medical treatment and care. As the number of such persons increases, and in order to ensure protection under international law, the results of the empirical study indicate the need to provide immediate assistance to residents in safeguarding their rights to self-determination or private autonomy and legal interests in making health care decisions in social care settings. For example, involving the resident in consenting to treatment or establishing a decision-making assessment procedure.

This Directive comprises the reimbursement of healthcare costs in another member state. The establishment of the PRD was preceded by a long debate concerning whether the free movement of services includes healthcare. Its transposition seems to have been problematic, demonstrated by the large amount of MSs that experienced delay in its implementation..."

This Policy Brief presents the research questions, main results and policy implications and recommendations of the seven Work Packages that formed the basis of the ANCIEN research project, financed under the 7th EU Research Framework Programme of the European Commission. Carried out over a 44-month period and involving 20 partners from EU member states, the project principally concerns the future of long-term care (LTC) for the elderly in Europe and addresses two questions in particular: How will need, demand, supply and use of LTC develop? How do different systems of LTC perform? ENEPRI Policy Briefs extract the policy implications of research carried out by member institutes of the European Network of Economic Policy Research Institutes. Initiated by CEPS in 1999, ENEPRI conducts research on welfare and employment issues with the aim of diffusing research, coordinating research plans and increasing the awareness of the European dimension in national problems (see www.enepri.org). This document describes the Dutch system of long-term care (LTC) for the elderly. An overview of LTC policy is also given. This document is part of the first stage of the European project ANCIEN (Assessing Needs of Care in European Nations), commissioned by the European Commission under the Seventh Framework Programme (FP7). Since the first stage of the project aims to facilitate structured comparisons of the organisation of LTC for the elderly in different countries, comparable reports have been written for most other European countries (including new member states). Future analyses in subsequent work packages within the project will build on these country reports.

In 1984-87, the Skaevinge Municipality applied Integrated Home Care based on self-care theory and using the action research method. After 10 years (1997) the Municipal Committee, requested the Danish Institute of Health Care to undertake an impartial investigation of what effects the Skaevinge Project, had on the older population of the Municipality compared with the rest of the county and nationally. The goals were: 1) Health care was to be made available to all citizens in institutions and in their own homes. 2) Prevention and support to maintain and strengthen the citizens' own health and quality of life, were to be prioritised. The method used meant that citizens had jointly decision-making and the staff were given autonomy and competence, built on trust from the policymakers. The results derive from the perspectives of the citizen (questionaries), the staff groups (interviews) and the society at large (interviews and statistical analysis). Catalog Description: The purpose of this course is to introduce students to legal issues in public health and healthcare. Basic legal principles underlying the legal system, governmental regulation, development of legal rules, and how to interact effectively with the legal system as a public health practitioner will be explored. This course has two main purposes: first, to examine the legal context of the relationship between the individual and the community; and second, to understand public health regulation in the context of a market-driven system.
